TERMS & CONDITIONS

Please read these terms and conditions carefully before ordering from our online website  www.modernhomesbathrooms.co.uk  
Together with our Privacy Policy they set out the details of the relationship between Modern Homes Bathrooms Limited and yourself, as customer.
By ordering from this website you are agreeing to be bound by these terms and conditions. If you do not agree, you may not use this site to order goods.

The term 'Modern Homes Bathrooms' or 'Modern Homes Bathrooms Limited' or 'us' or 'we' refers to the owners of the website whose registered office is 137-141 Norton High Street, Norton, Stockton-on-Tees, TS20 1AA. Our company registration number is 6950736. The term 'you' refers to the user or viewer of our website.

Please note that we are unable to accept any order from persons under 18 years of age. If you are under 18, you may only use this website to order goods with the consent and involvement of a parent or guardian.

PRODUCTS

Whilst we have taken every care to describe and give specifications for products on our website accurately, and to display pictures that give a true representation of these products, we cannot be held responsible for slight variations in design or colour. Our suppliers may vary their designs slightly, without immediate reference to ourselves. Colours depicted on your monitor may alter according to the resolution.
We therefore exclude any liability for any such inaccuracies or errors that may have occurred in the inputting of information into this website.

If an error has occurred in the pricing of an item, either in under-pricing or over-pricing, we are not obliged to supply the item at the price given before conclusion of the order, provided we notify you of the error before delivery, at which time we will give you the opportunity of cancelling your order for that item. At this point we will offer you a full refund if you so wish.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It will be your responsibility to ensure that any products, services or information available through this website meet your specific requirements.

AVAILABILITY

All items are delivered, as requested, subject to availability. We will endeavour to indicate the actual availability of any item at the time of selection, but should it become unavailable we will contact you using the details you supplied to us. You may be offered an alternative item of equivalent quality and value, where possible, or be given the opportunity to cancel the order at no cost to yourself. In the event that contact is not possible, any remaining item(s) on the order will be processed and delivered, and the value of the unavailable item(s) will be refunded to you.

DELIVERY

We will make every effort to ensure that items are dispatched on time.
Title for the goods delivered will only pass to you once Modern Homes Bathrooms Ltd has received payment in full.
Delivery occurs when the items are delivered to the address specified by you and at this point, responsibility for loss, breakage and damage passes to you.

Please note we only deliver to addresses within mainland England, Scotland and Wales.
Your order may be part-shipped.

Our normal delivery hours are 9am - 6pm Monday to Friday. A signature will be required to accept delivery. Please supply an alternative address if necessary.
Where possible our courier will contact you prior to shipment to organise delivery.
Please note that if goods are returned to us due to no-one being there to accept the delivery, a £15.00 handling charge will be applied.

The period stated within which you will receive your order is approximate and we can only guarantee delivery within 28 days.

For goods delivered by pallet, the driver will make every effort to deliver as close as possible to your home. Delivery drivers are not, however, insured to take their vehicles off the public highway.
If your property is located in a private road, along a narrow street, or via a flight of stairs, or if access is difficult for any other reason, the driver will endeavour to deliver as close to your home as possible.

Most deliveries are made by a single driver so the assistance of an able-bodied person will be required to assist with lifting.
Under Health & Safety regulations, the driver cannot lift heavy goods on his/her own.
Drivers are not insured to take items into your property. They may agree to do this at their own discretion but are under no legal obligation.

We would advise against organising the fitting of goods until delivery has been received and checked for damages or discrepancies.

CANCELLATION OF ORDERS

Please note that made to order/bespoke items and w.c. seats removed from original packaging cannot be refunded - see Exemptions below.
To cancel your order please email: customerservices@modernhomesbathrooms.co.uk. as soon as possible. A cancellation must be received by us in writing no later than 7 days after receipt of goods. We are not obliged to accept returned items or refund for them after this period.
Emailed cancellations are accepted.
You should receive confirmation of your cancellation. If you do not, please contact our sales team by telephone (details can be obtained from our Homepage/Contact Us or at the end of these Terms).

EXEMPTIONS

We regret that we cannot accept cancellations, nor supply a refund for -

bespoke items:
whirlpool baths or products that have been made or drilled to your specification
w.c. seats that have been removed from their packaging

- unless found to be of unsatisfactory quality or meeting any one of the five criteria as outlined under 'Returns'.
Your statutory rights are not affected by these exemptions.

Should you refuse delivery for such items, the full cost of the item, carriage and return carriage must be borne by you.

Once you have selected the delivery option at the checkout stage of your order, you are agreeing to enter into the delivery service contract.

Once items have been dispatched from our warehouse the contract cannot be cancelled.

Please do not refuse delivery of items unless all items on the shipment are damaged as you will be charged the delivery cost and collection fee.

RETURNS

In accordance with your statutory rights as a consumer, claims for refunds, replacements or repairs will be offered as applicable if goods are found to:

not be of satisfactory quality
not be fit for the purpose for which they are sold
not correspond with their description
not correspond with the sample displayed on the website
be sold without good title

Items which have been fitted fall under the description of 'accepted items' and therefore cannot be returned for refund. (Statutory Rights still apply)

We will commit to bearing the cost of returns under the terms of the consumer's rights.

Please note that when you buy goods over the internet, or other distance medium, you have the right to cancel your contract at any time up to seven working days after receipt of the goods, under the Distance Selling Regulations 2000. You must, however, notify us of your intention to cancel the contract within the cancellation period, in writing, under these provisions.  
You will undertake to take care of the goods whilst they are in your possession and to return them to us promptly and in their original condition and packaging.

You are entitled to remove goods from their packaging for reasonable examination but in doing so you would become liable for any resulting damage or alteration caused. Under these provisions you would have to bear the cost of returning the goods yourself. At such time we would strongly advise that you return goods by recorded delivery and retain proof of posting or accompanying paperwork. Without proof of posting, we would be unable to provide a refund, should this be a requirement.

FAULTY GOODS/MISSING ITEMS

We would ask that all goods are examined upon receipt of delivery,  and that we are notified immediately of any faulty items.
Please examine packaging and inform us if you believe goods have been damaged by the courier. To assist us with our claim, any and all evidence, including photographs of damaged packaging/rough handling etc would be of great help to us.
We will have a claim against our couriers for any items damaged in transit whilst being sent to you and would therefore request that you retain all original packaging with the goods in order that our claim is not invalidated.
Please contact us via our Customer Services Dept stating whether a refund or replacement is required.

Please note: items returned must be accompanied by a Return's Form - available upon request by emailing us at the above address.
Please do not write on packaging or mark it in any other way or this may affect your right to a refund. Items should be returned with a label attached to the packaging using clear tape.
For larger items, we can arrange for a courier collection.

The above statements do not constitute a full indication of your rights as a consumer. Full details of your rights, when purchasing goods over the internet, can be obtained from your local Trading Standards and/or Consumer Direct.                                                                  

PAYMENTS

Payment in full must be made at the time of order confirmation, using a credit or debit card, or any one of the secure payment options offered on our website.
We regret that we cannot accept cheques.

All prices are inclusive of VAT, where applicable, at the current rate.
Product prices do not include delivery charges which will be added to your order before you commit to final confirmation.

If an error has occurred in our pricing, you will be advised by telephone or email and further confirmation will be required from you before your order is processed. You will be eligible for a refund on that item if you choose to cancel the order.

Any debit or credit card used for payment must be owned by you.
Your order may be refused if payment is declined by your card issuer.
